Host Insurance Coverage Terms and Conditions
By subscribing to Filmplace.co (“the Platform”) and utilizing the insurance coverage add-on plan for property owners and location hosts (“Host Insurance”), you, as the host or property owner (“Host”), agree to the following terms and conditions. These terms are legally binding and are designed to clarify the rights, responsibilities, and liabilities of all parties involved. Please read them carefully.
1. Eligibility for Insurance Coverage
1.1. Host Insurance is available exclusively to Hosts who are subscribed users of the Platform. Non-subscribed Hosts are not eligible for this coverage.
1.2. Hosts must maintain an active subscription during the booking period for which the insurance coverage is sought.
2. Activation of Host Insurance
2.1. Host Insurance coverage is only activated if the following sequence of steps is completed:
a. Damage Identification: The Host discovers damages to their property caused during the booking period as per their Filmplace's booking itinerary.
b. Dispute Filing: The Host files a dispute through the Filmplace Dispute System, providing detailed evidence of the damages (e.g., photos, videos, receipts, or invoices).
c. Negotiation: The Host attempts to negotiate a resolution directly with the Creator, including options for repair payments or engaging the Creator's vendor for repairs.
d. Resolution Breakdown: If negotiations fail and no resolution is reached, the Host escalates the dispute to the Filmplace Dispute Team for intervention.
e. Evaluation by Filmplace: The Filmplace Dispute Team evaluates the evidence and makes a final decision regarding the resolution of the dispute. In the event the dispute is resolved, the insurance will not be activated.
f. Police Report Filing: If the Creator becomes uncontactable, unwilling to pay, or refuses to cooperate, the Host files a police report detailing the damages and the Creator’s actions. The Host must upload the police report to the Filmplace Dispute System to proceed.
g. Insurance Claim Submission: Upon receiving the police report and confirming all prior steps have been completed, Filmplace facilitates the insurance claim process with the third-party insurance provider.
2.2. Failure to complete any step in the outlined sequence will render the Host ineligible for insurance coverage for the reported damages.
3. Claim Procedures and Deadlines
3.1. All claims must be initiated through the Filmplace Dispute System within two (2) weeks of the booking’s end date. Claims initiated beyond this period will not be considered.
3.2. Hosts must provide all required documentation, including photos, videos, repair invoices, and the police report (if applicable), to substantiate the claim.
3.3. Filmplace’s role is limited to facilitating the submission of claims to the insurance provider and does not guarantee claim approval.
4. Service Charges for Claim Facilitation
4.1. In the event of an insurance claim, the Host agrees to pay Filmplace a facilitation fee equivalent to 15% of the total claimed amount.
4.2. This service charge will be deducted from the claim payout or invoiced separately, as applicable.
4.3. Filmplace reserves the right to withhold the submission of claims to the insurance provider until the facilitation fee agreement is acknowledged by the Host.
5. Third-Party Insurance Provider
5.1. Host Insurance is offered through a third-party insurance provider (“Provider”) unaffiliated with Filmplace.
5.2. Filmplace acts solely as an intermediary to facilitate the purchase and claim process. Filmplace is not responsible or liable for:
a. Decisions made by the Provider regarding claims, coverage, or exclusions.
b. Any disputes, delays, or rejections of claims processed by the Provider.
5.3. For detailed terms and conditions, including coverage limits, exclusions, and claim procedures, please refer to the insurance policy document attached or provided directly by the Provider.
6. Indemnification and Liability Waiver
6.1. By subscribing to the Host Insurance, the Host agrees to indemnify, defend, and hold harmless Filmplace, its officers, directors, employees, and affiliates from any claims, liabilities, damages, or expenses arising out of or related to:
a. Insurance claims made under the Host Insurance plan.
b. Actions or omissions by the Provider, including but not limited to claim rejections, delays, or partial payouts.
c. Any damages or disputes not covered under the terms of the Host Insurance policy.
6.2. Filmplace is not responsible for ensuring that the Host Insurance meets the specific needs of the Host. The Host is encouraged to carefully review the insurance policy and consult the Provider for any clarifications.
7. Limitation of Liability
7.1. To the maximum extent permitted by law, Filmplace shall not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to loss of income, reputational damage, or property repair delays arising from:
a. The Host's failure to comply with the insurance terms.
b. Any denial, delay, or limitation of insurance coverage by the Provider.
7.2. Filmplace’s total liability in connection with the Host Insurance is strictly limited to the subscription fee paid for the service, excluding any coverage amounts.
8. Amendments and Updates
8.1. Filmplace reserves the right to amend or update these terms at any time without prior notice. Hosts are advised to review the terms periodically to stay informed of any changes.
9. Governing Law and Jurisdiction
9.1. These terms and conditions are governed by the laws of Singapore.
9.2. Any disputes arising out of or related to the Host Insurance Plan shall be resolved exclusively in the courts of Singapore.
By subscribing to Host Insurance, you acknowledge that you have read, understood, and agreed to these terms and conditions, including the associated processes, facilitation fees, and limitations. If you do not agree, please refrain from subscribing or utilizing Host Insurance services.
